Terms and Conditions

 

These buying- and delivery terms apply to orders made by the customer at the website gulbla.com. The terms constitute an agreement between you and Gul&Blå AB, 55675-5464 (”Gul&Blå AB”), Hustegavägen 1, 181 90 Lidingö (hereinafter "Gul&Blå AB" or "we").

 

When purchasing from the website, you commit to the following terms. We therefore ask you to read the terms carefully.

 

ORDER

 

To place an order, you must be 18 years old or older.

 

Orders that are placed in someone else’s name without their consent will be reported.

 

We reserve the right to correct prices for all orders including final purchases. If a price is incorrect, Gul&Blå can cancel the purchase and refund the amount paid. This can be done at any time.

 

ORDER CONFORMATION

 

An order confirmation will be sent immediately after a purchase to the stated e-mail address. It is of importance that you specify a correct e-mail address to get the information about potential delays or other important events regarding your order.

 

In the order confirmation, you can find your order number. We use this to identify your order if you need to get in contact with us.

 

SHIPPING

 

Free shipping is applied when ordering over a certain amount and depends on the delivery address. In cases where a charge for shipping is added to your order, it will be displayed in connection to the order.

 

DELIVERY

 

Stocked products ordered before 12:00 are usually shipped the same day. The delivery time is 2-3 working days. You will receive a text message, e-mail or a notification form when it is available at your delivery point.

 

PRODUCTS NOT IN STOCK

 

Usually the products are in stock that are available for order on the website.

 

Should there occur an incorrect stock balance that affect your order not to be delivered within a reasonable time we contact you as soon as possible and you will get the possibility to cancel your order and get a full refund.

 

If a product no longer is available for purchase, Gul&Blå has the right to cancel the purchase and make a full refund.

 

PAYMENT

 

We offer the following choices: bank- or credit card, Klarna and Paypal.

 

PRICES

 

All prices at the website include VAT, in accordance with applicable law. If an order is delivered to a delivery address outside of the EU, VAT will not be added to the price.

 

Please not that if an order is sent to a country outside the EU, any import duties and taxes may apply, which will be charged when the shipment reaches your delivery point. You are solely responsible for paying such import duties and taxes. Gul&Blå does not have any control over these fees nor has the possibility to predict the size of them. We recommend that you contact your local customs office for further information.

 

RETURNS

 

Our hope is of course that you are satisfied with your purchase at Gul&Blå, but if you change your mind we offer full right of withdrawal within 14 days. This only applies to unused products and the products must be in the same condition as it was when received.

 

When withdrawing the purchase, put the unused product in the same packaging as it arrived in. Seal the bag carefully and put the return form over the address form and send it back.

 

If you regret your purchase the refund will be made without unnecessary delay. However, we will have to wait with the refund until we receive the product back from you. We will use the same means of payment for the refund that you used for the initial purchase.

 

You will return the product back to us at the stated address below without unnecessary delay and in any case no longer than 10 days after you informed us of your decision to cancel the purchase/withdrawal of the agreement. The withdrawal period shall be deemed to have been observed if you return the product before this period expires.

 

Make sure to pack the product carefully so it will not be damaged in the transport. You are responsible for the condition of the product until it has arrived at our warehouse.

 

If the product is damaged or used when it arrives, we will deduct the refund. The shipping return fee when using the right of withdrawal is paid by you.

 

We recommend that the product is sent as a trackable package as it is you as a customer who is responsible for the goods until it is received by Gul&Blå.

COMPLAINTS

 

If we deliver a defective product, please contact us as soon as possible so we can resolve the issue. Send an e-mail to kundservice@gulbla.com and describe the error.

 

If we cannot solve the issue you are of course able to return the product and receive a new one. Complaints must be made in accordance with the instructions you receive from us and to what is stated below. The warranty covers products that are incorrect according to current consumer protection legislation. If your wish to report a valid error in the ordered product, Gul&Blå must be contacted as soon as possible after the error was discovered. Use the contact details listed above. Complaints made within two months from the time the error was discovered are always considered to have been submitted on time.

 

Gul&Blå stand for the return shipping fee for approved complaints. However, this only applies when the return shipping note we provide for is used.

 

Defective products must also be handled carefully and packaged as if they were new.

 

When the defected product is returned and the complaint is approved, Gul&Blå will compensate you in accordance with applicable consumer protection legislation. Gul&Blå strives to ensure that this is done within 30 days of receiving the complaint. Gul&Blå reserves the right to deny the complaint if it turns out that the product is not incorrect according to current consumer protection legislation.

 

In the event of complaints, Gul&Blå complies with the guidelines from the General Complaints Board or equivalent committees in other European countries, ARN, Consumer Europe and the ODR-platform. You can find more information at the Consumer Agency (Konsumentverket).

 

 UNCLAIMED DELIVERIES

 

The shipment is with the postal office for 14 days before it is returned to us. Gul&Blå charge SEK 450 per piece for unresolved packages to cover our costs. Unclaimed packages do not include the right of withdrawal under the Distance- and Home Sales Act (Distans -och hemförsäljningslagen).  

 

If you regret your purchase when the package has been shipped from us, you must pick up the package at your delivery point and then make a return notification and then return your order. If the package is not retrieved, it will automatically be registered as not being retrieved and then debited.

COPYRIGHT

 

All content on this site, such as text, graphics, logos, images, audio clips, digital downloads and other software, belongs to Gul&Blå or our suppliers and is protected by the Swedish and international copyright laws.

 

WRONGS

 

We reserve the right for any errors in the information on the site and reserve the right to change prices without prior notice. Gul&Blå reserves the right for price adjustments, final sales, inventory differences, technical problems, changes to technical specifications and any typographical errors on our site/advertisements. We reserve the right to cancel incorrect orders.

 

INVALIDITY OF THE PROVISION

 

If a court or other competent authorities’ judges that a provision of these terms is invalid or non-enforceable, this shall not affect, invalidate or make it impossible to enforce the other provisions of the terms. The application of the provision shall be enforced to the extent that the law permits as close as possible to the spirit of these terms.

 

FORCE MAJEURE

 

Delay due to circumstances beyond Gul&Blå’s control and which Gul&Blå could not reasonably have expected, such as, for example, general work conflict, lightning strike, fire, war, terrorist attack, altered government regulations or other public regulation, errors in the operator's network, general shortage of transport, goods, communication or energy or other similar circumstance as well as delay or error in services from subcontractor/consultant due to circumstance stated here, is not Gul&Blå’s responsibility. Such circumstances shall constitute a basis for exemption for Gul&Blå, which entails the advancement of time for performance and exemption from liability for damages or other sanctions. If Gul&Blå is unable to fulfill its obligations due to circumstances mentioned above, Gul&Blå must inform the customer about this and state the circumstances that constitute Force Majeure. Gul&Blå should also inform the customer when the circumstances that make up Force Majeure ends. If the circumstance lasts for more than two (2) months, both the customer and Gul&Blå have the right to cancel the purchase with immediate effect.

 

APPLICABLE LAW AND DISPUTE

 

At first hand, disputes shall be resolved in agreement between the customer and Gul&Blå. In order to give the customer freedom of choice to resolve a possible dispute outside a traditional court, Gul&Blå always follows the recommendations of the General Complaints Board. Disputes concerning the interpretation or application of these terms and conditions shall be made in accordance with Swedish law and, if the customer and Gul&Blå cannot resolve the dispute in consensus, shall be decided by the General Complaints Board or, ultimately, by the public court.

 

CHANGES OF BUYING TERMS

 

Gul&Blå reserves the right to make changes to these terms and conditions on an ongoing basis. Changes to these terms will be published on the website. The terms that were published at the time of the purchase apply to each purchase.
